Terms and Conditions

1. Introductory Provisions

These Terms and Conditions govern the relationship between: Petr Přikryl Herbenova 2173/12 695 01 Hodonín, Czech Republic ID: 07984588 A natural person registered in the Trade Register. Non-VAT payer. Email: petr.obrazy@seznam.cz (hereinafter referred to as the "Provider") and the customer (hereinafter referred to as the "Client"), who submits an inquiry for the Provider's services via the website.

2. Subject of Services

The Provider offers in particular the following services:

  • Custom pet portraits

  • Paintings for children's rooms

  • Wall and large scale murals

  • Other artistic works based on individual agreement All services are realized based on an individual inquiry and subsequent agreement between the Provider and the Client.

3. Inquiry and Conclusion of the Contract

3.1. Submitting an inquiry form or an email does not create a binding order. 

3.2. The Provider will subsequently contact the Client with a proposal, price quote, and terms of realization. 

3.3. The Contract for Work is concluded at the moment the Client confirms the price quote in writing via email. 

3.4. A deposit may be required for orders. Its amount and due date will always be stated in the individual offer.

4. Price and Payment Terms

4.1. The price is always determined individually according to the scope, complexity, and type of the order. 

4.2. The Provider is not a VAT payer. 

4.3. Payment is made by cash on delivery or by another method according to individual agreement. 

4.4. The price is payable according to the agreement stated in the confirmed offer.

5. Delivery Terms

5.1. The realization period is determined individually based on the type of order and time requirements. 

5.2. The finished work is handed over in person or sent by cash on delivery to the address of the Client. 

5.3. Shipping costs are communicated in advance in the price quote.

6. Withdrawal from the Contract

6.1. In the case of custom production (painting tailored to the customer's requirements), it is not possible to withdraw from the contract according to Section 1837(d) of the Civil Code, as it is goods modified according to the customer's wishes. 

6.2. If the order is canceled by the Client after the work has started, payment for costs already incurred may be required. 

6.3. The Provider reserves the right to withdraw from the contract in the event of a serious breach of the agreement by the Client.

7. Complaints

7.1. The Client is obliged to inspect the shipment upon receipt. 

7.2. In case of damage to the shipment during transport, it is necessary to write a damage report with the carrier. 

7.3. A complaint can be filed by email at: petr.obrazy@seznam.cz 

7.4. Complaints will be handled individually without unnecessary delay.

8. Copyright

8.1. The Provider is the author of the created works. 

8.2. The Client is not entitled to further commercially use the work without the consent of the author. 

8.3. The Provider reserves the right to use the realized work for their presentation (website, social networks), unless the parties agree otherwise.

9. Protection of Personal Data

The Client's personal data is processed only for the purpose of processing the inquiry and realizing the order in accordance with applicable legal regulations.

10. Final Provisions

These Terms and Conditions are valid and effective from the date of publication on the Provider's website.
